Why is date of separation such a contentious issue in divorce? Well that date dictates division of debts but more importantly division of assets. We had a 2 day trial in that issue where husband and wife disagreed on the date of separation. The Wife stated in the petition the date was in 2012 and husband stated in the response the date was in 2016.
The evidence used by both was: calendars, photos, cards and since they were both huge letter writers the letters they wrote to each other. Also, social media played a major role in the trial as what was posted on social media was used by each party to try and prove whether they were together at a certain point or not. Taking all of the above evidence and the parties’ testimonies the court chose a date in the middle.
